PERSONAL DATA AND CONFIDENTIALITY
ART.1 Types of personal data
The
MERCHANT has the right to collect and use information about USERS after
they place an order for goods or services. The information by which the
person can be identified may include:
name and surname
address
telephone
email
as well as any other information that the person voluntarily provides when ordering.
The
information also includes any other information that the CUSTOMER
enters, uses or provides when using the services provided by the
MERCHANT. In the contact form filled out by the CUSTOMER when ordering,
the MERCHANT indicates the mandatory or voluntary nature of providing
the data and the consequences of refusing to provide it.
By
accepting these General Terms and Conditions, the CUSTOMER agrees to
the processing of his/her personal data for the purposes of this
contract and direct marketing.
By
clicking on the virtual button "Complete the order", which has the
force of written confirmation of the General Terms and Conditions, the
CUSTOMER makes an electronic statement within the meaning of the
Electronic Document and Electronic Signature Act, by which he declares
that he is familiar with these General Terms and Conditions, accepts
them and undertakes to comply with them. By recording it on a relevant
medium on the TRADER's server, through a generally accepted standard for
conversion in a technical manner, making its reproduction possible, the
electronic statement acquires the quality of an electronic document
within the meaning of the cited law. The TRADER may store in log files
on its server the IP address of the CUSTOMER, as well as any other
information necessary for his identification and reproduction of his
electronic statement of acceptance of the General Terms and Conditions
in the event of a legal dispute. The text of these General Terms and
Conditions is available on the TRADER's WEBSITE in a manner that allows
its storage and reproduction.
In
case of providing false data, the TRADER has the right to terminate or
suspend immediately and without notice the provision of services to the
CLIENT.
ART.2 Purposes of processing
The personal data received by the TRADER is used for the following purposes:
serving USERS, including accepting and fulfilling orders and contacting USERS in case of problems related to the order;
to facilitate access to the service;
sending
newsletters and/or periodic notifications only in electronic format -
e-mail and/or by telephone (with a phone call or short message);
statistical purposes.
The described purposes for which the information is used are not exhaustive and do not create obligations for the TRADER.
ART.3 Consent
Where
reasonable, practical or required by applicable law, we will request
your consent before collecting or using your personal data. The request
for your consent will be clear and specific and will provide you with a
reasonable basis on which to make your decision. Your consent is
voluntary and can be revoked at any time, for example by terminating a
specific service or by contacting the TRADER at the Company’s management
address or at the email address provided in the TRADER’s contact
information. If you do not give your consent, it may not be possible for
you to use services or parts of services provided by the TRADER
ART.4 Collection and processing of personal data without consent
The
collection and use of data may also be necessary to comply with legal
requirements. When collecting or using recorded data for these purposes
and for similar legitimate interests of the TRADER, we will generally
not seek your consent, unless this is deemed necessary in the specific
case or is required by applicable law.
ARTICLE 5 Period of retention of your personal data
We
will retain your personal data only for as long as necessary to fulfil
the purposes set out in this policy or the purposes for which you have
otherwise been informed. This means that where you have consented to the
processing of your personal data, we will retain the data for as long
as our customer relationship continues or until you withdraw your
consent. If you have withdrawn your consent, we may still retain certain
personal data for the period necessary to enable us to fulfil our legal
obligations and defend ourselves in legal disputes. If we have not
obtained your consent to the processing, the personal data will only be
retained to the extent that we are permitted to do so by law.
ARTICLE 6 Rights of the CUSTOMER regarding his/her personal data

6.1 Right of access - You have the right to request information about
your personal data that we store at any time. You can contact the
MERCHANT at the specified contacts, after which your personal data will
be provided to you by e-mail.
ART.6.2
Right to portability - Where the TRADER processes your personal data in
an automated manner based on your consent or on the basis of an
agreement, you have the right to receive a copy of your data in a
structured, commonly used and machine-readable format, transferred to
you or to another party. This includes only the personal data you have
provided to us.
ART.6.3
Right to rectification - You have the right to request the
rectification of your personal data if they are incorrect, including the
completion of incomplete personal data.
ART.6.4 Right to erasure - You have the right to request the erasure of all personal data processed by the TRADER.
ART.6.5
Right to object to processing based on legitimate interest - You have
the right to object to the processing of your personal data based on the
TRADER's legitimate interest.
ART.6.6
Right to restriction - You have the right to request the TRADER to
restrict the processing of your personal data in the following
circumstances:
if
you object to the processing based on the TRADER's legitimate interest,
the TRADER will restrict the processing of the data pending the outcome
of the verification of the legal grounds.
if
you claim that your data are inaccurate, the TRADER must restrict the
processing pending the outcome of the verification of the accuracy of
the personal data.
if
the processing is unlawful, you may object to the deletion of your
personal data and request the restriction of their use instead.
if the TRADER no longer needs the personal data, but you need them for the exercise or defense of legal claims.
ART.6.7
Right to lodge a complaint with a supervisory authority - If you
believe that the TRADER is processing your personal data incorrectly,
you can contact us. You also have the right to file a complaint with the
supervisory authority, which as of the date of adoption of this policy
is the Personal Data Protection Commission.
ARTICLE 7 Implementation of the CLIENT'S rights under the GDPR
To exercise your rights under the GDPR, you can write to us by e-mail or send us a letter by post to the contact details.
Applications
in connection with the exercise of your rights are generally submitted
in person or by a person expressly authorized by you. An application can
also be submitted electronically, in accordance with the Electronic
Document and Electronic Signature Act. Where there are regulatory
procedural rules in connection with the exercise of your rights (in the
Personal Data Protection Act and other acts), they must also be complied
with.
ARTICLE 8 Protection of the CUSTOMER's Personal Data
The
MERCHANT shall exercise due care and be responsible for protecting the
information about the CUSTOMER that has become known to him in
connection with the order of goods and services - subject to these
General Terms and Conditions, except in cases of force majeure,
accidental event or malicious actions of third parties.
The
data will not be provided in any form to third parties or used for
purposes other than those described above, except for the cases provided
for in this Policy.
The
restrictions under parag. 1 shall not apply in the event that the
MERCHANT is obliged to provide the personal information about the
CUSTOMER to the relevant competent state authorities in accordance with
the current legislation.
